1. Acceptance of Terms

By accessing or using OrderTrackify (“the Service”), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service. These terms apply to all users, including merchants, administrators, and visitors.

2. Description of Service

OrderTrackify is a shipment tracking and post-purchase experience platform. The Service allows e-commerce merchants to automatically track shipments, send customer notifications, and display branded tracking pages. The Service integrates with third-party e-commerce platforms. WooCommerce is generally available through its plugin; Shopify and Wix are feature-gated integrations whose onboarding availability depends on the deployment.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription & Billing

OrderTrackify offers tiered subscription plans. By subscribing to a paid plan, you agree to:

• Pay the applicable subscription fees on your selected monthly or annual billing interval
• Authorize us to charge your payment method via Stripe
• Understand that plans purchased directly through Stripe use AUD catalogue prices; exact AUD amounts are labelled “Including GST” or “Excluding GST”, while subscriptions managed by a commerce platform such as Shopify may be listed and billed in that platform’s supported currency
• Understand that non-AUD amounts are single estimates based on daily reference rates and labelled “Excluding Tax”; Stripe sets the final supported currency, applicable tax, and amount before you confirm payment
• Understand that subscription fees are non-refundable except as required by law

We reserve the right to change pricing with 30 days’ notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users’ accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to send unsolicited communications (spam)
• Exceed the shipment limits of your subscription plan
• Share API keys or account credentials with unauthorized third parties

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.

7. Third-Party Integrations

The Service integrates with third-party platforms (WooCommerce and feature-gated Shopify/Wix) and services (Stripe, TrackingMore, AWS SES). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability or reliability of third-party services.

8. Intellectual Property

The Service, including its source code, design, logos, and documentation, is owned by OrderTrackify and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the term of your subscription.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, OrderTrackify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless OrderTrackify and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service. You may terminate your account at any time by contacting us or through your dashboard settings.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be resolved in the courts of New South Wales, Australia.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
